Terms and Conditions:
1. The tenant will use the rented room by EPS (henceforth the lessor) as a temporary accommodation, establishing there a temporary residence because of studies.
2. After the stay agreed, the tenant must leave the property in the state of repair and cleanliness of how he had occupied it, without the need of any explicit request by the landlord. If the landlord does not want to renew the room or apartment he is not obliged under any circumstances. A desired extension of the contract should be made in writing one month before the contract running out. The realization of this writing does not correspond to the right to extend, it depends on the landlord.
3. The tenant agrees not to use the room rented for temporary or permanent stay of any other person, even family or friend are being prohibited such use, unless it is specifically authorized by the lessor, owner or representative and communicated in writing to EPS. Any misuse causes express termination of the contract. The room will be for the person or persons to sign the contract. Any guest will have to pay 10 euros per night. They will have to notify EPS. Finding other people in the apartment without notification means the breach of contract and therefore the loss of the deposit.
4. Payment will be made during the first five days of each month. In case that the payment is not accomplished in the first five days of the month a penalty of 10% of the amount of rent will be charged.
5. The months will be paid completely regardless of the day of departure and entry.
6. The deposit is established to meet the exact compliance of the obligations created by the contract and the damages that may occur in the accommodation and the existing furniture in it, as well as the final invoices of the costs of the accommodation. If the house is in perfect condition and all payments have been paid, it will be refunded the full amount after having returned the keys. The bond must always be in cash, there will never be accepted checks or any other ways of payment. The bond in no circumstances may be used as payment for the last month of stay and will be returned on the student’s departure day in order to await the final bills of supply. The bill will be sent to the address of the head lessee. In case that it is possible to return cash at the student’s departure, the student will accept the last invoices we have for calculating the extra costs. The deposit will be returned only upon delivery of the keys within the business hours of EPS.
7. Tenants acknowledge the receipt of the room and the furniture being in perfect condition, and giving the full agreement and at the same time receiving the keys for access, they become obligated to keep it in perfect condition. The reparation will be of the tenants’ part, both ordinary and extraordinary which have to be accomplished during the duration of the contract, as well as the part of finding and authorizing a professional dedicated to that purpose. EPS offers a trusted professional who can be called whenever needed. Similarly, the tenant will account for the costs incurred by damage, whether glass, locks, lost keys, other tools and utensils, water installations, gas, electricity, heating, toilets, faucets, sinks, heaters, washing machines, drainage, as well as maintenance, repair and replacement of window blinds and all those cracks resulting from the use without any exception. Tenants are obliged to allow entry to the workers that have to carry out works or repairs to common parts of the building. All students have a period of two days to report the damage or items that are not in perfect condition, after this it is assumed that everything is in perfect condition. All costs of repair or breakage after 48 hours (workdays) will be paid by the student. EPS can perform in the apartment works and improvements for the benefit of tenants and for the maintenance of the
apartment, without requiring prior authorization on the part of tenants. EPS informs tenants at the time they are going to undertake construction or improvements.
8. It is totally prohibited to conduct parties or other celebrations. In case of a complaint from a neighbour contrasted with a report from the police or joint ownership of property will entail the automatic expulsion from the flat and the loss of the bond. EPS will never be liable for any injury caused by festivals and other events. They must respect the hours of rest of the neighbours, especially by keeping silence from 22.00h (10p.m.) until 08.00h (8a.m.), and at the time of the midday break (siesta).
9. At the beginning of each month a representative of EPS may make a visit to each flat to check the state of cleanliness and maintenance. We will focus on common areas such as the bathroom, kitchen, livingroom). In case it is in a bad state a cleaning person will be hired and will be paid with the deposit of the students who live in the accommodation.
10. In case a room has been rented and the contract expires, the room will be revised in order to refund the deposit. As for the common areas flatmates must report any abnormality, otherwise we will understand that the apartment is in perfect condition, surrogates responsibility for common areas in the tenants of the remaining rooms.
11. If the tenant evicted or leaves the flat for any reason, prior to the expiration of this contract, will retain ownership and will endorse the amount received by way of guarantee. We will not accept any excuse and the loss of bail is automatic.
12. For all conflicts that may arise in the interpretation, application, effects and failures of this contract by the contracting parties are subject to the jurisdiction of the courts in Malaga.
13. If necessary or in extreme case the landlord can evict the flat to students for any serious cause, at least 1 month prior warning, and offering a similar option.
